These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and the creators and operators of Winter Dating App ("Winter", "we", "us", "our"), available on Google Play under package identifier com.app.screentime.
By downloading, accessing, or using Winter, you affirmatively represent that you are at least 18 years of age and have the full legal capacity to enter into these Terms. We maintain a zero-tolerance policy towards harassment, unlawful solicitation, unauthorized commercial recording, and explicit non-consensual content.
1. Eligibility & Age Restriction
You must be at least 18 years old to register an account or use Winter. By creating an account or accessing any feature, you represent and warrant that:
- You are 18 years of age or older.
- You have never been convicted of a felony or sexual offense, and are not registered as a sex offender in any jurisdiction.
- You will comply with these Terms and all applicable local, national, and international laws.
- You do not have more than one active personal account on Winter.
2. Account Creation & Biometric Security
To access matching, chatting, and calling features, you must establish an account. You agree to:
- Provide genuine, accurate, and current profile photos and details. Using pictures of celebrities, stock images, or other real individuals without consent is grounds for immediate termination.
- Maintain the secrecy and confidentiality of your login credentials. You are solely responsible for all activities occurring under your credentials.
- Utilize the built-in Biometric App Lock (fingerprint or face authentication) on supported Android devices to prevent unauthorized physical access to your conversations.
3. Code of Conduct & Prohibited Activities
Winter is designed to foster kind, authentic, and mutually consensual relationships. You expressly agree NOT to:
- Nudity & Sexual Content: Post, broadcast, or display nudity, pornography, sexually explicit gestures, or solicit commercial sexual services during discovery, chat, or video calls.
- Harassment & Bullying: Stalk, intimidate, abuse, defame, threaten, or harass any user. When a user declines a match or ends a call, you must respect their boundaries.
- Non-Consensual Recording: Take screenshots, video records, or audio recordings of 1-on-1 video or audio calls without explicit written consent. Our software provides anti-screenshot flags to reinforce this standard.
- Impersonation & Scams: Impersonate any person or entity, execute financial scams, promote unauthorized MLM schemes, or solicit money from other users.
- Malicious Code & Scraping: Use automated bots, scrapers, emulators, or reverse-engineer the APK to extract user databases or disrupt servers.
4. 1-on-1 WebRTC Calls & Live Interaction
Winter provides peer-to-peer real-time audio and video communications through WebRTC:
- Calls are encrypted end-to-end between participants. Winter does not listen to or store audio or video feeds.
- Both callers have the right to end any call instantly at their discretion.
- Users may block and report abusive behavior directly from the live calling screen or chat window. Violators will face immediate hardware/device bans.
5. Virtual Coins, Talk-Time Credits & Purchases
Winter may offer virtual tokens ("Coins" or "Credits") enabling premium features such as extended 1-on-1 video minutes or sending virtual gifts:
- License Only: Virtual Coins are licensed to you on a limited, revocable, non-transferable basis. They possess no real-world cash value and cannot be redeemed for fiat currency.
- Transactions: All purchases are processed through official Google Play Store In-App Billing or designated authorized UPI gateways. Winter never collects or stores your credit/debit card numbers or bank credentials.
- Refund Policy: All digital coin purchases are final and non-refundable once credited, except where required by Google Play billing policies or mandatory statutory laws.
6. Safety Disclaimer & In-Person Meetings
IMPORTANT SAFETY WARNING:
Winter does NOT conduct criminal background checks or identity verifications on general users. You are solely responsible for your interactions with other users. If you choose to meet a match in person:
- Always meet in a public, well-lit place (e.g., a café or restaurant).
- Inform a friend or family member of your whereabouts and plans.
- Arrange your own independent transportation to and from the venue.
- Never send money, share bank details, or reveal your physical home address.
7. Intellectual Property Rights
The Winter application design, logos, graphics, brand identity, codebase, Zona Design System elements, and trademarks are the exclusive proprietary property of Winter and its licensors. You are granted a limited, personal, non-exclusive license to use the app for personal, non-commercial dating and social communication.
8. Suspension & Account Termination
We reserve the right, without prior notice or liability, to suspend, ban, or terminate any account that violates these Terms, infringes on community safety, or engages in fraudulent behavior.
You may delete your account and profile at any time through the in-app settings menu. Upon deletion, your profile will be immediately withdrawn from discovery.
9. Disclaimers & Limitation of Liability
WINTER IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR ACCESS TO OR USE OF THE APP, USER INTERACTIONS, OR OFFLINE MEETINGS.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts located in India.
